US citizen needs some immigration help?
would she be able to stay here if our baby is born here in the USA, while waiting on her resident status?
Thanks in advance
Answer:
Whoa! Cincy needs a hug. You need to consult with immigration officials in both countries to find your best option.
Just have her stay...legal or not...have the baby here then they can NEVER deport her!
Then get married...that makes it even harder.
Don't worry about INS or any other immigration laws...they don't enforce them anyway.
Just do what the hell you want and have a good life.
Don't let anyone tell you different. At least you are a citizen and are having a child out of love...not for citizenship.
Tell her I said welcome to America....best wishes!
this is why fornicating before marriage is a sin. God made these rules to prevent situations like this.
anyway, your best bet would be to go over there and wed. if she comes here, she still risks being deported and the baby will be a bastard child.
if you want to come back here ,trust me, get married here
legally
then do a wedding thing where ever you want to
and likely live where ever you want to.
Bring her home here. She'll be fine.
you need to go to the consulate in Sweden. She can apply for a fiancee visa before you get married. The wait time should be six months or less. You will need to prove that you can financially support her.
The baby is not a good enough excuse according to immigration law for her to be allowed to stay in the US. Even being married to you will not save her if she is not legally here.
