American Visa? which is best for permanent immigration into the United States, I have a 4yr old son Born in US
I am a UK born resident with an American 4yr old son, born in San Diego, I am living in UK but intend to move to USA permanently soon, I don't want to go in, on an I94 Visa Waiver. What Visa should I apply for? how long does it take? I need to work or set up a business with American friends there.
(PS his American mother is useless so that is not an option for possible marriage visa) (we never married)
We appreciate any help
Answer:
It depends on what you want to do once you're in the US.
If you want to work, there's a couple of choices:
B1 is the standard work visa. Usually good for up to a year, must be renewed. Does not allow you to move to permanent residency status, though. Is tied to your employer (if you come in with a job offer), or may be issued to you as an entrepreneur.
L1 is another reasonable one, if you're an executive. Usually good for up to a year, and can be renewed. Does not allow you to pursue permanent residency. Is tied to the company that sponsors you into the US.
H1B is the "elite" visa; however, only a limited number availabel in a calendar year (65000, tops). Hard to get ... this year's applications were exceeded on Day 1 of the availability ... 258000 applicants for 65000 visas. Valid for maximum 3 years, may be renewed once. Will allow you to pursue permanent residency. Is tied to the company that sponsors you. Has some hard criteria regarding your occupation (only available to professional in a couple of fields). Visas are "open for application" around 1 April, and close when the list is full (in the case of 2007, on April 1!). Applications do not carry over from one year to the next; each year must be applied for (again) if the previous year's application was not accepted.
You can also come as a student or tourist; however, you must prove solvency since in both cases you are not allowed to work or seek employment. In some cases the student visa will allow you to start the permanent residency process ... each one is different. Student visas are tied to the school and the degree program which has sponsored your entry.
Hi David, I dont have good feelings about of the economy of USA becouse the dollar is going down according to the analysts, but anyway if you must to do... do it! and for in just appy for visa turist and later when you are into and working in some job try speak with your boss and explain your situation and if he can sponsor to you for apply visa work.

Good luck!
Unless you are in North Ireland and qualify for the diversity lottery (opening in October) your best bet is probably an H1B visa, to adjust down line to a green card. Go to uscis.gov for the options, though.
