Both, If the employee lies send them back to their country after a time in Jail. Fine the employer for each offense and put their behinds in jail also. A month for the first time there after 2-10 yrs. along with a 500 thousand dollar fine.
Who would you put the burden on? The employer should check the background of the employees. And if an alien fools them, the employer should not be held very responsible for that.

It is already supposed to be this way, according to the current law. The employer is already supposed to require 2 forms of ID in order to hire anyone, then fill out the form stating what the ID's were and the numbers.

We both know that business like restaurants, small business have large turn overs will not bother, another problem is that if you are a illegal, but have the name and social security number that is stolen, but valid is will pass.
