My Filipina finacee is living in Korea, but her visa to live in Korea expired. I went back to the States a little over a year ago, and deployed to Iraq soon after. I submitted the paperwork to get her a K1 visa, and everything is done except for the interview, which she cannot do until I am back in the States, according to the U.S. Embassy in Seoul. Thus far, we have had no problems in obtaining or completing ANY of the requirements/paperwork, to include the police clearance. Will her expired Korean visa be an issue? I have heard that there is an amnesty period during which she can leave the country without penalty. I also had a Pinay friend who had overstayed leave Korea and come back after she had gotten married to an American who was still living in Korea, and all they asked her at the airport when she left was why had she overstayed. Can anyone provide any useful information?
