DOB in passport is as per school L.C actual D.O.B. in municipal record is different.what to do now?
Answer:
This problem arises in case of non-registration or wrong registration of birth or the details of place,DOB,name of parents correctly spelt etc and especially in case of visa or admission to educational institutions in USA and some other countries. In India, SSLC is taken as the basic record for DOB for all purposes including passport but the USA and some European countries insist on Municipal records only. The system of registratio was stabilised for about 300 years there and yet to stabilise in India, despite statute for compulsory registration, in place.
For expediency sake don't rush and take hasty steps or through touts going by the name of agencies. Forget municipal record. Take SSLC as the basis since for future purposes in India, you should not encounter problems.
As per Indian law and State rules amended from time to time, the correction of municipal record is an arduous task and may entail a year's time at least, after a court case. Not to scare, but to put you in perspective, even after correction, in municipal records, corollary action with every department, like State Seconary Board, Ration Card, Passport, driving licence, voters list etc would be enormous and tedious. So, forget it.
There are rules in the country where you propose to emigrate, detailing the documents, acceptable as proof of date of birth. Elicit information and assess the easiest one and try to obtain the same recording DOB as in SSLC AND Passport.
One such document, I have come across, is a sworn affidavit by the parents, and duly notarised. In the unfortunate situation of parents not being alive, affidavit by an elderly person, who had personal knowledge of the matrimony between the parents (either as per religious customs or by registration under Hindu Marriages/Special Marriages Act) and also knowledge of the birth of the child born out of this wedlock, as to the DOB,POB and the name assigned at or after some time of birth of the child.
As to the format prescribed if any, you have to eenquire and obtain the draft. Otherwise, go to the nearest Sub_registrar's office or court complex where the typing pool typists themselves will arrange to verify their own draft by an advocate, type out on requisite stamp paper, get the Deponent (person swearing the affidavit) identified by an advocate, present it to a notary and get it executed before him. Insist on entry in the notarial register (most don't do unless insisted), assigning a serial number. The cost of this in lumpsum would be about Rs.300 to 500 depending upon the place. You can get a young lawyer at random near the typing pool in the court complex and get the entire work got done in say 30 minutes and the cost would be at the lower end.
no need of muncipal certificate if u r born after 26 jan 1989
Get it corrected on your passport, because when you apply for Visa for any country it is preferable to have same DOB on your passport and municipal record.Otherwise your parents will have to give affidavits to justify real DOB.
