As I've said before. If you break the law you are a criminal. It's rather simple. If I were to speed and as a result I am issued a speeding citation I have therefore broken the law making me a criminal until I satisfy the requirements of my punishment for breaking that law causing me to be a criminal.
An illegal alien is a criminal as long as that person remains in this country. 24 hours a day, 7 days a week, 365 days a year that immigrant is a criminal.
If you read the constitution, you'll see it does not define what makes a criminal, instead, it is a document meant to limit the powers of the federal government, limits they have obviously overstepped. One might say that the federal government does not have the right to make immigration laws and so, since these laws are unconstitutional, immigrants are not criminals, but neither are they citizens.
Criminal = someone who've commited a crime. And IMO yes, those who break our laws are criminals. They don't do it on purpose (commit the crime) but their trespassing and coming to our country wuthout taking the proper steps to become a citizen. So yes.

The Constitution does not define thing like the word "criminal." The Constitution only lists a couple of crimes, counterfeiting money, treason and I believe one other. The Constitution gives the responsibility for passing federal criminal and civil laws to the Legislative Branch.
Federal laws are intended to address federal questions only. Immigration falls into this category.

Interesting that the second sentence of the Introduction reads: "We The People" affirms that the government of the United States exists to serve it's citizens. The key word being Citizens. Not illegal immigrants. It seems to me, a lot of our "so called leaders" are confused on who is the citizen, and who is the criminal.
Anyone entering our country illegally is committing a criminal act. Therefore, they are criminals.
