This would depend on how you view this problem of illegals illegally crossing our borders. I personally view this as an invasion to take over from within. This Bill that is pending is proof of that to me.
If you however view this as an acceptable number of illegals.then it's an issue of law.

Your idea is Constitutionally sound. But, our government has not followed the Constitution for many years. There are also too many multi-cultural bed-wetters who would somehow outlaw it.
The Constitution is referring to a "States Right". If your State calls for the need of a Militia, then you may join it.
Nope as soon as they cross that border they have rights just as we do. Probably more that we do. There are certain agencies that are responsible for finding and deporting illegal immigrants. They have the training required to carry out their jobs without making the US look like a bunch of idiots. Giving some dumb redneck a gun and a mission would do the exact opposite. The constitution does not call for private militias. Militias must be under the direction of the C in C. There is a private militia in Philadelphia that dates to the Revolutionary War, but it operates as a National Guard unit. I think the most you could do would be make citizen arrests, but if Federal policy is catch and release, they'd just let them go. They'd also spy on you as dangerous radicals. I attended the rally in Washington and was warned by an organizer that they'd probably open a file on me as a radical nutcase who shows the American flag and asks his congressmen to enforce the law - oh, the horror!
And by the way, the government is lying when it says it can't deport illegals. It just doesn't want to.

I think most of the time when illegal immigrants aren't deported by the government, it's because the government doesn't know about them. If you want one to be deported, you could probably just alert the INS to their presence, and they'd take care of it. Like the minutemen do.
