Indefinite leave to remain uk?
Answer:
Depends on what u mean by limited residency ? . My husband has juast been refused ILR even though he has been here for 6 years and we have 2 children. The Immigration do not see it that way, all they say is that he decided to have a child knowing full well that he never had leave to remain.
Plus the fact that u ar not together it will be even harder to be granted ILR.
The immigration see thousands of cases like this evey year, what makes u think that your case, or my case should be made an exception.
The immigration here stinks!!!!!!!
Depends on the reason why he's in this country in the first place.
He won`t get it just because of the kid.
The kid won't help him get ILR
He knew he was not a resident of the UK when he fathered the kid so that just makes you both a bit careless, it does not give him any more rights to stay here, just another immigrant searching for loop holes in the system, hope he gets booted out soon.
What do you mean by you are not together, do you mean you don't live together or that you have split up? Even if you have separated, as there is a child involved, it would be a breach of human rights to separate the child from his father. I do think he needs to obtain some legal advice to find out what his options are, he may need to attend a court hearing for a decision to be made.
