I have a boyfriend who is not a us citizen?
Answer:
Novak-9 & Doug are correct. I know that you probably care about your bf & vice versa, but reading your story makes me wonder.. I mean, I don't think he's being responsible at all for jeopardizing his legal status in US like that (by not enrolling as a full-time student; for undergraduate student, that means taking at least 12 credit hours). Being an international student, he should know what it takes to keep his legal status in US & probably has access to an immigration counsellor at his school.
Other than those options you mentioned above, some other ways he could live here in US legally (either as non-immigrant or an immigrant):
1. As a non-immigrant: if he can find a job that matches his education, he could have his employer file for an H-1B visa application, which is a 3-year non-immigrant visa, which could be extended to another 3-year period. However, if he hasn't completed his degree, it'd be almost impossible to find an employer who would want to employ him.
2. As immigrant: depending on which country he's from (people from certain countries are not eligible to participate), he could apply for a DV (Diversity Visa) status, by participating in a DV/green card lottery. However, just like any other lottery, it really depends on luck to win a slot to have a chance to get a green card.
I know you don't want him to leave & neither does he, but don't rush into getting married just so you could be together; not until you're both ready for marriage, & not until your bf gets his schooling done!! You could try as much as you could, but sometimes, if you're not meant to be together, you'll just have to let it go.. If you're meant to be together, even if he ends up having to go back, time & space will be the greatest test for a true love.
I actually experienced quite a similar thing back when I was in college: I was an international student dating another international student from a country different than mine. Basically, in his country, men in particular age group had to go back to serve in the army!
apply for the green card. the fact that he is your boyfriend is irrelevant until the day you get married. get a quicky wedding in vegas.
He don;t love you. He loves the green card. This a well known scam. Find a NEW bf.
He is not able to apply for naturalization because he was here for five years. F-1 visa holder has to keep his full time student statues in the school he applied for F-1 visa with. He can be deported at any time.
He can apply for I- 140 or I-130 immigration petiton and adjustment of statues in the state. Again he should kept his F-1 visa statue.
In your case, talk to immigration lawyer ASAP.
Talk to an immigration counselor. In my town there is an Immigration Counseling Service that I used.
Talk to an expert. Consultation is free.
Disregard what most of these people here say. They really don't care. They're just here for entertainment.
Good luck.
if he was here on a student visa...NONE of those 4 years count towards naturalization. sorry. and no, there are no other options for you except to get married, or for him to continue school and be on a student visa. for now, that is it. you can't start gathering years towards naturaliztion until you are an official legal resident with a resident card. a student visa isn't related to that at all.
For some reason I'm willing to bet that we are paying for his education. He should be held in jail until he works off his debt to the American people and sent back across the border at your expense since you are harboring a criminal.
Hate to tell you.. He has pretty much lost his chances of getting a green card because he came here illegally. Getting married will not help you in getting him citizenship!
