Help me please!! what if my husband has to leave?

ok I filed an I-190 form for my husband to be an american citizen. Meanwhile his visa is going to expire august 1st and we don't know what we should do. If he leaves the county to apply for a new visa it can take up to 6 months meanwhiule i will be here alone without enough money to support paying for everything. I cannot go with him because of my job and position. Is there any loop holes in the system that will allow me to get him an extension on his visa ( his company will not give him an extension ) ? what are our options?? I have contacted immigration many times about this but they will not offer me any information or help except go back to his own country until he gets a new visa. Please guys help us we don't have much time before the visa expires.

Answer:
Your husband's first responsibility was to keep track of his visa and renew it in a timely manner. I say, get that guy out of my country. The INS has given clear instructions, though they may not be the answers you like. Quit looking for loop holes and do the right thing! If you do not, you will be directly responsible for aiding and abetting a criminal. This is punishable by permanent deportation for your beloved and federal charges for you.
i dont know how we can help you. Immigration has told you he has to go back and get a new visa. Seems that the only option is to do that if he wants to be legal. If he overstays his visa and gets caught he will be deported and not allowed back for years. Six months seems like a small time in comprarison to years.
He can come back later.
Simple as that.
Look, my father came here years ago, before I was even thought of, legally. He later brought over his brother. My father was sponsored by his aunt and uncle, then my Mom and Dad sponsored my uncle. He neglected to mention that he had married. Well, my parents filled out the paperwork, and it was just for him, not knowing about my new aunt. She waited in the "old country" for her own separate paperwork to come through.
If your job is that great that you can't give it up, then wait for the paperwork to go through. Took my aunt and uncle a year to be reunited. They lived through it.
Our military personel are being shipped out and not seeing their families for extended periods.
Can he not work when he gets home and help pay for things to get processed?
My parents waiting to get married until my father was a citizen, which meant this sort of sticky problem didn't even come up.
And of course you won't go back to his country with him. Seems to be the majority opinion on here, nobody wants to go the country of the spouse they love so much.
America's borders are blurry at this point, but love sure does have its borders.
You MUST do what immigration says. If they say he has to leave, he better leave.

If he doesn't then he will be an illegal alien. That won't help him as we works to become a citizen!
you've already called immigrations. he'll have to go home and apply again. good luck
Your kidding right how long has your husband been in this country for one thing that you are now filling out his form for American citizenship now that his Visa,is about to expire on August 1st.
With all of the heated debate that is going on in this country about illegal immigration you really had the guts to put in your question are there any loop holes in the American justice system so you can keep your husband here, are you serious
Listen if ICE.tell you that your husband will have to return to his country than what do you expect ICE,to tell you they are the ones who enforce the immigration laws do you really think they are going to help you jump through some loop hole in the law with the tension in this country on this issue,I will say it again I don't get why you waited until time was running out to file for a new Visa, and American citizenship knowing how long it takes and what your husband would have to do like leave the country something just does not fit right with this ok!
What are you worried about? We have millions of illegals here, the chance of him getting caught are slim. If he does get caught just have him say "I want to vote democrat" and he will be released.
he should go back get a new visa and then come back and filled out the proper paper work
Sure, I'll be glad to give you a million dollars so you can buy off your politicians.
What is the I-190? You cannot apply for your husband to be an American citizen, u can Apply for him to be a permanent residence. U can go to the immigration website and look around. You need to file forms I-130, I-485, I-765 and all supporting documents, good luck
Sorry, if they say go back, he has to go back or he will face charges. They INS doesn't care if he has a house, children or a wife. He needs to do it the right way. This why Americans are complaining. He doesn't have any right to stay after August 1st. Please do it right or your consequences will be worse in the future.
I hope the best for the both of you, but I will keep my opines to myself on this one.
Sorry to say it is very clear cut. sorry to say. If you have previous actions in court and had a lawyer well things could be delayed. But Aug.1st is too close regardless.

Heres the thing. 9 times out of 10 to work things out the fastest is to have someone return home and have the citizen apply. You could get lawyer but unless you throw thousands it will take forever.. in the meanwhile he will be illegal and then you are not talking 6 months but years.

Bottom line if you do not have $10,000 to get a temporary injunction and ICE has said he must go... he must go. They are passing laws about overstaying visas which basically say that if one has ever overstayed they can never get entry again. If you are a citizen you can work it out but it will cost far more than 6 months of wages later if he does not go home.
Sorry but he will have to go for the 6 months. It really isn't that long of a time and you don't want him to be illegal, that may seperate you permanently. I wish you the best of luck.
