he is a citizen of el salvador, he came with a tourist visa 6 years ago but he overstayed his visa. now i want to see if i can fix his legal status of get him a green card? how dificult can that be, and where can i get the exact and correct iinformation on how to proceed in this case.
what happens if they do aprove the application i will summit, how long does he needs to wait to get the greencard, or can he get a work permit meanwhile he waits for application to be process?

Answer:
You're in luck. He entered the country with a visa. Even though he's an illegal alien now, he'll be allowed to adjust status. If he had entered illegally, without a visa, he'd be required to leave and it might take years for him to come back.

File an I-130 (petition), I-485 (change of status) and I-765 (work permit request), along with all the supporting documents, with the CIS all at the same time. Understand? You need to file them all at the same time.

The fees to file go up, way up, after July 30th. File before then and you'll save about $1,000 in fees.

You DO NOT need a lawyer. A lawyer will take about $2,500 of your money to fill out the same three forms and prepare the additional information requested.

I assume he's been working in the United States. I hope he's been filing his state and federal income taxes each year. There's a tax question on the form. If not, he's got possible trouble from the IRS in his future.
Your situation is very easy.since he did come to the U.S. LEGALLY, he can fix his status much easier than if he would have come here illegally. I recommend you go to the INS office in your city to get help (if you don't want to spend money on a lawyer) but I personally recommend you do get help from a lawyer because any minor error can delay his process!!

As he came into this country DOCUMENTED, he is able to have his status adjusted. Thats because he entered the country legally, he just simply over-stayed his visa. no problem. You will need to file forms l-130, l-485 (adjust to perm status) and form l-765 (work permit).
The work permit can be issued within 90 days of petitioning. once he has his work permit, he should go to the social security administration and apply for his social security card. He can then work legally. the total cost for this will be around 900.00 or more as you will have to pay for his medical exam as well.
You should file all of these at the same time as to move this along in a timely manner. It took my wife and stepson almost 2 years to get theirs this way. It is quicker now.

Be advised that the cost on these forms will rise starting on july 30th, 2007, so you may want to file these quickly to save alot of money.

EDIT- one good thing about him getting his work permit and going to work immediately will be that his income can be used as well as yours to meet the financial requirements that filing for adjustment of status brings. :)
According to Immigration Law he is a deportable alien due to fact that he has violated his terms of his B-2 visa.
If he entered the US leagally,which he did, then you can file a petition. As soon as you file, he will be eligeble to apply for a work permit.
