Ok lost my I-94 washed my pass by misstake no stamps shown entered 1998 they still can track me down?

It really depends...the Immigration Service is supposed to have a record but their record keeping is kind of bad and they also don't have manpower. However if you happen to be at wrong place at wrong time, you might land in trouble. Local police usually does not enforce immigration laws but it depends on where you live- in SF they don't but I was watching CNN and there is a place in IL where Sherriff is arresting illegals. It is clear that you are illegal. Mostly when a new law passes giving rights to illegals, the "burden" to prove stay is on the illegal person. There is no better way to show proof than I94. You should find it. It might be beneficial.
