Truth be told, neither political side wants to do anything about it... They both benefit from it... And it is the presidents responsibility to protect the nation... and then we get some bone heads that get made when we do? (sorry ACLU, but you are mucking it up) When does a criminal have more rights than a law biding citizen?
Democrats are against making it a felony.
Republicans in the house want to make it a felony and to increase fines on companies that hire illegal aliens.
It is not a felony, I believe it is a civil misdemeanor. Exceeding the speed limit by a certain amount however is a felony... what part of illegal don't people understand?
Its not a felony. And local police cant and dont get involved in immigration. First, if local police asked and/or enforced immigration policy, these people would not call the police if they were victims of crime. Perps would soon figure this out and rob, rape, and murder them. I know that sounds far fetched, but that really would be like painting a target on illegal immigrants.
Second, if the local cops enforced immigration, there would be no need for the few thousand immigration agents we have working for this country. That would be a big loss of jobs and benefits and you know the different unions wouldnt stand for that.
What does the fact that it is a federal law have to do with it being a felony or not? Illegal immigration will always be around as long as it is not a felony, and if it were a felony- there would never be enough jail space to hold the "criminals" anyway. There isn't enough jail space now to hold the detainees who are criminals much less the ones that are not criminals (who are just waiting to be deported).
You're correct they fall under FEDERAL JURISDICTION.Any illegal detained for an offense is only subject to the states laws regarding that offense.Once police have determined the detainee is illegal they call Homeland Security to ask what is to be done.IF THE DETAINEE isn't on the terrorist watch list Homeland Security WILL NOT intervene with prosecution.So the Illegal is then only subject to what a citizen would recieve according to the crime.So he will be set free as would a citizen for a misdemeaner.The bill before Congress changes this.PLEASE read it so our laws can be changed.
Finally this topic is opening every ones eyes as to the reality of( too little too late) so deal with it you criminals.....for harboring them.

First offense is not a felony. Local and state law enfrorcement does not have access to the computer systems which provide immigration information. ONly federal law enforcement. However, local and state law enforcement can contact federal law enforcement to inquire about a person's immigration status.
You have to maintain at least a secret clearance to access these data bases.
NO it isint a felony,it should be, then they could do more to stop them when they catch them. My father was a police officer and caught some and was told to let them go if they werent felons,so go figure.
I don't know, but I do know that 29% of the inmates in Federal prisons are ILLEGALS! And that 95% of the murder warrants in LA are for ILLEGALS! That should tell all of us something! I guess Bush wants to make THEM legal, too, the scumbag!
Yes it is a federal offense to cross into this country illegally. We have so many local law enforcement who are not going to do anything because they have been told that it's not their problem it the Fed's problem. The problem I see with this is all law enforcement officer's take an oath to uphold the laws of not only their state, But of this country. So this makes them law breakers as well as the people in charge of the policy to do nothing. All you have to do is go to a federal court house near any border city and watch this type of so called justice in action. Months in jail and then taken back to the border and released. I've been told by many in the federal justice system that these people are back before all the paperwork in completed. We need to seal the border off and deal with these people as criminals with true consequences for their actions.
