I have H-1B from a non-profit organization and I want to transfer it to a regular company how do I do that?
Answer:
Thats true! H1B's sponsored by universities, govt agnecies, certain hospitals and non profits are not counted against the cap. If you want to work for a "for profit" organization, your H1B transfer has to be counted against the cap for that year. If the quota has been used there is no way you can transfer until its available again. The new quota opens on Apr 1st 07 and is expected to be over in a week or two. Check out forums on www.immigrationvoice.org. You might get more specific answers.
H-1B visas are employer-specific, whether you stay in the non-profit sector or move to a regular company. If you change employers, you'll need a new visa.
It's not your H1B visa. Your employer paid for it. If you want to change jobs you'll need a new H1B visa sponsored by your new employer.
Your Non-Profit H1B does not come in H1B cap. If you are going to work in profit making org then you need to transfer visa and which comes in cap. You may need to wait for new quota to open for new year.
The cap is filled pretty quickly and you'll be subject to it if you change out of the non-profit org. If you really want to change jobs, you may want to look for another non-profit place first.
My friend transfered from a non profit to profit organization after the cap got over.He was able to sucessfully transfer. But i would recommend you to refer a attorney. The cap for H1b transfer does not make sense too.I think you should be fine.
