I am a Marine who has been married to an illegal for 3 years. But I can't get her citizenship, need help.

I have talked to many lawyers concerning this matter. But everyone has told me that it is useless to continue to file applications. I am wondering about all the prior military people to marry foreigners, how they got there significant others papers. And why can't I. I am in need of some serious help. My wife needs to get back to Mexico before here father dies, and to bring back her son. Any help is deeply appreciated. I am out of resources at this point.

When you start from "illegal" it's not possible to end up at legal. That's why you can't get her "papers."

Here is the God's honest truth on how to get her legal. Let her go back to Mexico. Let her live there while you file an I-130 for her. She's likely to be banned from returning to the United States for several years. Let her serve out the ban. Then, when she's eligible, let her come here legally.

While she's serving her ban you can file a petition to cut or eliminate the ban on humanitarian grounds. Maybe it will be granted, maybe not.

That's the way to do it. Don't forget, it was her act of illegally entering the United States that caused the problem. Every year tens of thousands of Americans get married to foreigners who have not illegally entered the United States. They have very few problems.
A friend of mine said that just because you are married to someone dosen't make them legal anymore. She said they have to live here for 15 years and be married for that 15 years then they can get their citizenship.
It all depends on how she came in the country and whether she has been deported before. You can apply for her to become a legal resident in some cases, and it's actually not that long and complicated a process. You can even do it yourself, most times you don't even need a lawyer. Also, you don't need to wait 15 years. If a person is married to a US citizen, they only need to be married for 2 years to be able to become a legal resident (in most cases, and depending on how the person got here) and 5 years to become a US citizen. Go to www.uscis.gov and you will find all the info you need, plus all the forms to fill out, free. Hope this helps.
I don't think you can do much, but if you wait a little longer the new amnesty bill may pass and she can apply under the new program.
My wife is a Mexican and she came to the US on a visitors visa, so she was here legally when we decided to get married. I applied for an adjustment of status and she is now a legal permanent resident. I believe you have a better chance if she is in Mexico and you file for a relative visa. It will take a long time but I don't think there is another way. I did a relative visa ap for my step daughter but it is not complete yet so I can't tell you how it will turn out. I am waiting for an interview now and it has been about a year since I filed the fist on the papers. Good luck... You might consider moving to Mexico. I am moving there in 3 more years. I love southern Mexico. The state of Chiapas is mountainous and above 5500 feet it looks just like Oregon and the temperature stays about 75 degrees year round... Beautiful place... If she has no criminal record of any kind here in the US, what you will have to do to legalize her and get her a green card would be to, go to her native country and get married legally.
you'll have to leave her behind, but not for long. You come back to the US and you start the process of getting her back here legally. you'll have to go to www.uscis.gov. Download and print froms I-130, I-864, G-325. Follow the instructions and you should be good.
You should have done it legally at first,,and instead of thinking with your big head, now you want help.. She needs to go back and you can try and adjust her status, but she needs to prove residency in Mexico, until the process is accepted and approved, gotta do it legally Devil Dog...
