It is a problem to leave the US without I-94 which has been submit togther with the adjusment of status form?

I also have an advance parole document but I don't have I-94 because I send it to USCIS with the ajustment of status form. my document is still pending. it is a problem when I re-enter the US with the advacne parole without sumbit the I-94 when depatured?

Answer:
Yes you can have a problem, if the USCIS haven't recorded it on the computers, which often they don't.
You shouldn't have sent them the original I-94, you should always keep it on you. (passport)
When you leave the US, they usually take it from you.
When you re-enter, you get a new one.
The problem is they might ask you where the other one is, as they might see that it was not surrended.
You see, there are people who give them to others so they can leave with without problems (if they are illegal).

Parole papers does not guarantee you re-entry either. The USCIS should have told you this when you got them. If paperwork or computers are not up to date or something, immigration at Port of entry can refuse you entry even with those docs.
Especially as you don't have the old I-94.

My suggestion would be if you have the time before you leave the US again, make an appointment to see someone at your local office, hopefully they might find it in your file there. Or they can hopefully call the department who can try and locate it with your other forms.
If not apply for a replacement of I-94. It will cost you though. And it does take time to replace one.

Remember, never give anyone your original I-94 unless they request it.
Even if you renew your passport, you must take it off until new one is issued, so you can staple it back in.

Here is some info on what to do to replace it..http://travel.state.gov/visa/temp/info/i...

Good luck
no problem if you have the Advance Parole document.
You could have a problem at departure. Probably not, but maybe. The safest course is to get a replacement I-94. Never send USCIS an original supporting document, only copies. If they want an original they will ask.

Forms of course must be originals and things like Labor Certs must be originals. Everything else is a copy! Keep originals in your safe and a copy in the freezer and a scanned copy on your desktop, your laptop, and a backup CD. Always assume USCIS will screw up your case, lose your documents, or otherwise affect you adversely. Everything must be bulletproof, everything is your fault unless you can prove otherwise, and perfection is a starting point (that is, if the case is prepared perfectly you MIGHT get an approval SOMEDAY).

Are you getting a clue as to how USCIS operates??
