Emigration said, has to leave, come back when papers ready..4-5 years.

So your visa is expired? You can be in the US with expired visa if your I-94 is still NOT expired. If your mother is legal, she could sponsor you to obtain permanent residency or your future wife could sponsor you as well (when you marry her). Hope this helps.
