Was is so wrong?
I have been in a relationship with an aussie for 5 years now. I am from europe. My partner didnt like Europe while he was visiting my family ( i cant blame him lol) so we decided to live in oz. I arrived on a visitor visa with my oldest son. We had to save some money for the visa application cost so I stayed on my visitor visa for 10 months. I got pregnant and by the time my visa was running out the immigration office decided to put me on a "medical visa", they said after the baby was born here in australia to apply for a defacto visa because it would be easier then. So we did what they suggested. A week after my second was born we made him australian.
We went back to the immigration office to apply for my defacto visa, they said there wouldnt be any problems and I would have it before the visa i was on would ran out. Ater 3 weeks we received a letter saying i couldnt get the visa because i didnt had "full custody" of my oldest son and that i had to leave the country with my oldest son. I couldnt take my newborn baby with me (he was only 2 months) because he didnt had a paaport yet. Yes people THEY ASKED ME TO LEAVE MY NEWBORN CHILD! All i could do was cry!
I felt (and still do) that i couldnt leave my youngest son behind so we decided to overstay my visa untill we got a paaport for our son and then we would leave straight away. Wich we did. I am barred for 5 years so we have to stay outside the country for 5 years even my partner and son are australian since birth!!
Now my question is, was it so wrong from me to stay illegal? I had no work, no payment benefits, NOTHING!!! So the tax payer didnt spend a single penny on me!
I just wanna say that been illegal is wrong, everybody knows that but people, not all of the illegals are bastards ore after money. Sometimes the goverment leaves you no choice.
I WILL NEVER LEAVE MY BABY BEHIND AND I RECKON EVERY MUM WILL AGREE WITH ME ON THIS.

I sincerely applaud you, government officials can't get their own act together. Many themselves corrupt the system, who are they making decisions on another person's life. In your situation, I would do whatever it takes, even if it means illegal actions.

That's really wtong. When it comes to the government, get everything in writing.
Unfortunately, most people aren't in your situation & if rules are less harsh to accommodate your situation, we'd have a lot more people abusing laws. It's really crappy, but I think your case would have been different if you'd have gotten written documentation of what they said each time you talked to someone. Then you could PROVE that you weren't just trying to be shady like everyone else.
I'm really sorry to hear about your situation - I hate government, I hope in America we can get a president who wants to cut down on government, but here immigration is a huge issue - nobody wants to get here legally, then they want to spend MY hard earned money by using 'social programs' to send their children to school, to get medical attention without paying for it, etc. It's unfortunate that these shady people have to ruin things for people like you.
Other than written documentation, I would have done the same as you.

There was time to conceive and give birth.Seems like enough time to iron out any impediments.
you and your partner should have gotten married!! and you should have worried about all this before having another baby where you were not a citizen. why didn't you ever file for custody? every mother has to do that now, even in the states!!
That is the liberals for you, Vote labour in october to stop this sort of thing from happening again, because labour is for the average people, the libs are for the super rich, that is why this country is starting to see poor people going further and further into poverty.
Look I am living in Australia. I know immigration office. They are really harsh but if you have enough proof that you have full custody of your son, I don't think they would have any objection. Is there any reason that they think the other way around?
Immigration officers are usually quite helpful when you go there and talk to them face to face. At the end, all of them human. They are all mothers and fathers. But I think the worst option is staying illegaly. If you get caught, you have no chance to say sorry. They kick you out and definetely you can not come back.
