The process of a non U.S citizen marrying a citizen of another country?

Answer:
well it is a HARD process. and it takes a long time. there are two ways you can go. you can become engaged and apply for a fiance visa. or get married and apply for a spouse visa. i will explain to the best of my ability both. i am currently going through the fiance visa. once you have decided that you want to get married you will need to apply with an I-134 petition for fiance visa. this will require information on both of you, you will need to gather proof of meeting in the past 2 years, along with other proof, like of an ongoing relationship, purchase of engagement ring, proof of your US citizenship. you will need to send a copy of your birth cert., passport, and his passport too. send copies of any plane tickets you have used to see each other picture of the two of you any proof you can get because if you dont send it now they will ask for it later and that will lengthen the time it takes. well when you are approved they will send you a letter saying they are send his paperwork to his embassy. once it arrives in his country he will need to be there, if in the case he is here visiting you he will need to go back. he will have alot of paperwork to fill out and needs his medical and criminal records, but its not over then, they will send him an affidavit of support which he will have to send to you to fill out and you have to send it back to him, this is a tricky form you will need to proov that you make 125% over the poverty level for 2 people per year, and a statment from your bank saying how much you have in your checking/savings, and check stubbs from your work a letter from your work stating your job, salary, and length of employment. once the gets this he may fax it to his consolate and they will schedule and appointment for and interview if he passes the interview and all your proof is validated he will recieve his visa to enter the US and marry you within 90 days, after the marriage he will also have to file an adjustment of status so they dont deport him and so he can work. this process from engagement to marriage and working will take about 10 months so be prepared.

the spousal visa is different. this is when you marry him while he is here or abroad and yes you will be married quicker but it is more complicated as far as getting him here legally. after you are married you will file a K visa for your spouse, and they frown upon you marrying without the fiance visa, i know its stupid. but it will take longer to get him here and you are not guarenteed that they will accept him at all. this visa can take up to a year and its never guarenteed. most people i have talked to say that the fiance visa is the way to go. i hope i could help and i do wish you the best of luck, it is a hard journey but its worth it if you are in love..also you do need to have www.uscis.gov as a bookmark because you will visit it ALOT. there you can download all your forms. also a good site that helps explain this process is www.visajourney.com it is really helpful. GOOD LUCK!. and keep your chin up! it has taken me 7 months but my fiance will have his interview in a couple weeks!
