If a person were to overstay their US visa by a number of months and then at a later point wished to return...
Answer:
If it was an overstay of 6 months or more, s/he is barred from reentering for 3 years. There may be a 212(d) waiver available if this is the case.
Otherwise, the difficulty will lie in trying to prove that the intention is to remain temporarily and not permanently.
Sorry - no one really knows anymore. There's a 300 page plus bill be debated on immigration right now . . .
None if they are honest about the mistake
They would prbably have a huge amount of difficulty getting through immigration. Best advice would be to tell the story to the US Embassy here and get it sorted out before travel.
The US immigration would be well withing their rights to refuse entry and you may have to fund your return the the UK.
Definitely will cause problem
ask AREA 51
Do us a favor...don't return.
a visa is an authorization to enter a country for a length of time , anyone overstaying the time ? is breaking the law .. and will be barred from coming again for a specific amount of years ..
you can be rejected and not allowed to re-enter ...therefore face deportation .with the consequences that go with that .
