No, it is not illegal. Think about all the outsourced workers in India. You can bet they don't have US Visas.

Please, don't take the job! Get a REAL job! Don't forget, the US has a "Don't Call" registry and you must abide by that. I HATE telemarketers! They infringe on MY right to peace in my home and I am very rude to them when they call me. Don't you have some other worthwhile skills besides talking on the phone and pushing yourself and a product on others? If I want to buy something, I will go out and find it. I don't need anyone calling me to tell me what I need and then trying to force me to buy it.
If you are paid by a Canadian firm and reside in Canada, you are subject to Canadian tax laws.
If you are paid by an American firm and reside outside the country, you are subject to the tax laws of the country in which you reside.

Be sure you understand the rules for cold-calling in tehcountry where you are going to be making the calls - both Canada and the US have a version of the "National Do-Not-Call List". However, both are aimed primarily at residential numbers, rather than business numbers. If the company is asking you to participate with the intent on reaching businesses, ask them how they are sure the number ios for an actual business. The fines (to you as an individual and to the company you work for) can be significant ... as high as $10k US per call, if proven guilty.
