They are civil courts. The misdemeanor for entering the US without permission is a federal criminal issue. If this misdemeanor was ever actually prosecuted, they would go before a federal judge first before going to the immigration judge. All the immigration courts decide is whether a person can stay in the US or if they have to leave. They do not prosecute people for entering the US without permission.
illegal immigration doesn't even go through the courts its called criminal trespassing.. all they receive is a fine... and it would be considered criminal.. a civil court is like family court/divorces etc.. criminal means you go against the state or the country...
