Wow...I can't believe that. I guess his lawyer must have come up with a great arguement to keep him here, either that the judge was very liberal. I have a friend a from Honduras who tried to get asylum because her parents where killed because of their political beliefs. She and her brother were denied. They ended up getting a sponsor and getting citizenship, but to get asylum due to homosexuality is ridiculous.
What happens when they come here and say they are seeking asylum because they are persecuted for having a dog for a spouse? We put pressure on people of this country to meet some basic standards also and although we may not treat gays like that we would put pressure on a child molester. I don't think we should take in everyone who says they disagree with the culture in their country or that they are treated bad because the don't conform to morals of their country. We don't need them contaminating our country.

The appeals court can only overturn it on a point of law. I expect what happened is the guy said gays are persecuted and put in some evidence. Instead of putting on any evidence at all saying any persecution of gays isn't enough worse in Mexico that it should rise to asylum, the govt laughed at it. They should have introduced evidence. I suspect this can only happen once. And, of course, only in my state of California.
yes it is. There are other gay men in Mexico, though I never heard of one being persecuted because of their sexual orientation. So, in conclusion, he should get the same treatment as other Mexican citizens, no more no less. (as in get in line and apply for residence)
