Will I lose my visa if I get a divorce?

Ive been here in the USA for only 2 months.My husband wont file any more paperwork for my green card im her on a 2 yr visa please help!

yes you can. You will have to file on your own and ask for special dispensation. You will need to retain the services of a really good immigration atty asap. The conditional visa you would have received is based on your husband so you will need to start the process all over again on your own. Do it quickly because it takes a long time especially if you don't have a sponsor who is a US citizen.

Absolutely! you will need to file on your own and explain the circumstances as to why you should be allowed to stay (good cause). The problem is that if he is not cooperating, it will raise the suspicion that the marriage is fraudulent (under immigration law, all marriages are presumptively fraudulent until the applicant proves otherwise).

Best bet is to get an Immigration Attorney asap! DO NOT however, go to a "Notario" or Immigration specialist. These people are NOT attorney and cannot properly represent you should you be put in deportation proceedings. All they are allowed to do is help you fill out forms.

Of course the USCIS doesn't expect you stay married to a person you don't want anymore. You say you've been in the USA for 2 months but you don't say how long you've been married.

They will think it's very suspicious if you got married only a few weeks ago and now you're going to get a divorce.
