You fire him for falsifying his employment application. You then call Social Security and give them his old faked or stolen number.
Then you hire someone that is legal to be here.

I'd call immigrations and the IRS. and seen to it he was deported if found illegal. if the person is American i would call the police and turn his azz in. it's people like that, that makes it harder on Americans who's taxes go up higher. the innocent pay the price for criminals. besides, if amnesty is granted the employers will just fire the legals and hire illegals that will come in. after all they are all about making money, not giving it away.
Actually, an employer could find itself in hot water for firing someone who presents a ssn valid on its face--even if it's to correct a previously submitted social. Employers are between a rock and a hard place.
On the one hand an employer can't knowingly employ someone without work auth., on the other it cannot discrimate if facially valid documents are shown.

I'd fire their asses and call the FBI immediately to have them prosecuted for fraud and then I'd find out who really owned the number and advise them so that they could sue the "bleeps" and prosecute them to the fullest extent of the law
