If he's not a citizen, he doesn't have the rights of a citizen. If he's using a fake id then he has committed identity fraud which is a felony, tax fraud (also a felony and a federal crime) and a multitude of lesser charges. He will either be deported or put in prison. You won't be seeing your "baby-daddy" for a while either way.
I assume he is ILLEGAL? If so, HE HAS NO RIGHTS! If he is illegal, and a felon (ID theft), he should be deported!!!!!

Once you get to court, request that the police or prosecution provide "Full disclosure" this is a detailed account of the events of the investigation and details of the arrest warrant.
Your son's father? Wouldn't that be you? Anyways, what rights? I'm guessing he is illegal or he wouldn't have to possess a fake ID. That's two things illegal that he's done. The only rights he has is the right to go back where he came from.

Immigration warrant, sounds like he got a desk appearance ticket to straighten out his immigration status and never showed, that would be contempt of court.

He's, at the very least, hit the trifecta of immigration violations and this, um poor "undocumented migrant" (sarcasm) would be a model citizen in WHAT sense? Or deserve yet ANOTHER chance to snub his nose at our laws?
